1. Agreement to Terms

By accessing or using Arkos ("the Service"), operated by Arkos Analytics ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Arkos is a fantasy basketball analytics platform focused on EuroLeague. We provide:

• Player performance projections (PIR - Performance Index Rating)
• Lineup optimization tools for fantasy basketball
• Historical statistics and trend analysis
• Value rankings and player comparisons
• AI-powered analytics and insights

3. Eligibility

You must be at least 18 years old to use this Service. By using Arkos, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

5. Subscription and Payments

5.1 Free and Paid Tiers

We offer both free and paid subscription tiers. Free users have access to basic features, while paid subscribers ("Fantasy Plus") receive additional features including advanced projections, confidence scores, and priority access.

5.2 Billing

Paid subscriptions are billed on a recurring basis (monthly or annually) unless cancelled. You authorize us to charge your payment method at the beginning of each billing period.

5.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. We do not provide refunds for partial billing periods.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Scrape, copy, or redistribute our data without permission
• Use automated systems (bots) to access the Service excessively
• Share your account credentials with others
• Resell or redistribute our projections commercially
• Circumvent any access restrictions or rate limits

7. Intellectual Property

All content on the Service, including but not limited to text, graphics, logos, algorithms, projections, and software, is the property of Arkos Analytics or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM:

• Accuracy: Our projections are statistical estimates based on historical data. We do not guarantee the accuracy of any prediction.
• Fantasy Results: Using our Service does not guarantee success in fantasy sports competitions.
• Availability: We do not guarantee uninterrupted or error-free operation of the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKOS ANALYTICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Arkos Analytics, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law provisions.
